Het\u00a0nieuwe\u00a0kader\u00a0heeft\u00a0echter\u00a0op\u00a0een\u00a0aantal\u00a0belangrijke\u00a0punten\u00a0veranderingen\u00a0doorgevoerd.\u00a0Voordat\u00a0we\u00a0twee\u00a0concrete\u00a0gevallen\u00a0bekijken,\u00a0volgt\u00a0hier\u00a0een\u00a0beknopte\u00a0samenvatting\u00a0van de\u00a0basisbegrippen.\u00a0<\/strong><\/p>\n\n\n\n<p><\/p>\n\n\n\n<h2 class=\"wp-block-heading has-button-secondary-color has-text-color has-link-color wp-elements-c3cec101af8c913d175b52333d63206d\">Herhaling\u00a0van de\u00a0basisbegrippen\u00a0<\/h2>\n\n\n\n<h3 class=\"wp-block-heading has-button-primary-color has-text-color has-link-color wp-elements-7b4e52eaf7eb545a334fd627ceac3270\"><strong>1. Wat de SDT\u00a0beoogt\u00a0(en niet\u00a0beoogt)<\/strong>\u00a0<\/h3>\n\n\n\n<p>De\u00a0huidige\u00a0wetgeving\u00a0inzake\u00a0de\u00a0SDT:\u00a0<\/p>\n\n\n\n<ul class=\"wp-block-list\">\n<li>Heeft\u00a0<strong>alleen<\/strong>\u00a0betrekking\u00a0op\u00a0<strong>Walloni\u00eb<\/strong>.\u00a0<\/li>\n<\/ul>\n\n\n\n<ul class=\"wp-block-list\">\n<li>Is\u00a0alleen\u00a0van\u00a0toepassing\u00a0op\u00a0<strong>detailhandelszaken\u00a0<\/strong>met\u00a0een\u00a0<strong>netto\u00a0verkoopoppervlakte\u00a0van\u00a0meer\u00a0dan 400 m\u00b2<\/strong>, met de\u00a0mogelijkheid\u00a0om de\u00a0drempel\u00a0<strong>te\u00a0verlagen\u00a0tot\u00a0200 m\u00b2\u00a0<\/strong>als\u00a0de\u00a0gemeente\u00a0daartoe\u00a0besluit\u00a0(besluit\u00a0van de\u00a0gemeenteraad).\u00a0<\/li>\n<\/ul>\n\n\n\n<p>De\u00a0basisreflex:\u00a0controleer\u00a0zowel\u00a0de\u00a0<strong>regio<\/strong>, de\u00a0<strong>omvang\u00a0<\/strong>als\u00a0het\u00a0eventuele\u00a0<strong>gemeentelijke\u00a0besluit<\/strong>.\u00a0<\/p>\n\n\n\n<h3 class=\"wp-block-heading has-button-primary-color has-text-color has-link-color wp-elements-910e4e2bebf9aa70cdaf16e8ae3c8a96\"><strong>2. Het\u00a0sleutelbegrip: de\u00a0nettoverkoopoppervlakte<\/strong>\u00a0<\/h3>\n\n\n\n<p>Alleen\u00a0de\u00a0<strong>netto\u00a0verkoopoppervlakte\u00a0<\/strong>wordt\u00a0in\u00a0aanmerking\u00a0genomen.\u00a0\u00a0<\/p>\n\n\n\n<p>De\u00a0netto\u00a0oppervlakte\u00a0is\u00a0de\u00a0<strong>verkoopoppervlakte\u00a0die\u00a0toegankelijk\u00a0is\u00a0voor\u00a0het\u00a0publiek<\/strong>,\u00a0waar\u00a0er\u00a0een\u00a0(directe\u00a0of\u00a0indirecte)\u00a0uitwisseling\u00a0met de\u00a0klant\u00a0plaatsvindt.\u00a0<br>Deze\u00a0omvat\u00a0met\u00a0name:\u00a0<\/p>\n\n\n\n<ul class=\"wp-block-list\">\n<li>De\u00a0kassazones.\u00a0<\/li>\n<\/ul>\n\n\n\n<ul class=\"wp-block-list\">\n<li>De zones\u00a0achter\u00a0de\u00a0kassa\u2019s\u00a0waar\u00a0de\u00a0klant\u00a0nog\u00a0steeds\u00a0rondloopt.\u00a0<\/li>\n<\/ul>\n\n\n\n<ul class=\"wp-block-list\">\n<li>De\u00a0inkomhal\u00a0als\u00a0daar\u00a0goederen\u00a0worden\u00a0tentoongesteld.\u00a0<\/li>\n<\/ul>\n\n\n\n<ul class=\"wp-block-list\">\n<li>De niet-overdekte\u00a0oppervlakten\u00a0die\u00a0toegankelijk\u00a0zijn\u00a0voor\u00a0het\u00a0publiek\u00a0en\u00a0waar\u00a0een\u00a0commerci\u00eble\u00a0activiteit\u00a0plaatsvindt\u00a0(bepaalde\u00a0buitenruimtes,\u00a0luifels,\u00a0enz.).\u00a0<\/li>\n<\/ul>\n\n\n\n<p>Alles\u00a0wat\u00a0niet\u00a0toegankelijk\u00a0is\u00a0voor\u00a0het\u00a0publiek\u00a0of\u00a0waar\u00a0geen\u00a0directe\u00a0commerci\u00eble\u00a0interactie\u00a0plaatsvindt\u00a0(voorraden,\u00a0magazijnen, interne\u00a0kantoren,\u00a0technische\u00a0ruimtes,\u00a0enz.)\u00a0valt\u00a0<strong>niet\u00a0<\/strong>onder de\u00a0netto\u00a0commerci\u00eble\u00a0oppervlakte.\u00a0<\/p>\n\n\n\n<h3 class=\"wp-block-heading has-button-primary-color has-text-color has-link-color wp-elements-468ad92c8193d6ed8d1ed5e0de80084c\"><strong>3. Het\u00a0winkelcentrum:\u00a0een\u00a0optelsom\u00a0van\u00a0oppervlakten<\/strong>\u00a0<\/h3>\n\n\n\n<p>Het\u00a0begrip\u00a0<strong>winkelcentrum\u00a0<\/strong>blijft\u00a0centraal\u00a0staan.\u00a0<\/p>\n\n\n\n<p>Een\u00a0commercieel\u00a0complex\u00a0wordt\u00a0gedefinieerd\u00a0door\u00a0een\u00a0<strong>juridische\u00a0en\/of\u00a0feitelijke\u00a0band<\/strong>,\u00a0bijvoorbeeld:\u00a0<\/p>\n\n\n\n<ul class=\"wp-block-list\">\n<li>Dezelfde\u00a0vergunning,\u00a0dezelfde\u00a0eigenaar.\u00a0<\/li>\n<\/ul>\n\n\n\n<ul class=\"wp-block-list\">\n<li>Gezamenlijke\u00a0toegang\u00a0en\/of\u00a0parkeerplaats.\u00a0<\/li>\n<\/ul>\n\n\n\n<ul class=\"wp-block-list\">\n<li>Architecturale\u00a0samenhang.\u00a0<\/li>\n<\/ul>\n\n\n\n<p>In\u00a0een\u00a0commercieel\u00a0complex\u00a0<strong>worden\u00a0<\/strong>de\u00a0<strong>netto\u00a0commerci\u00eble\u00a0oppervlakten\u00a0bij\u00a0elkaar\u00a0opgeteld<\/strong>. Het\u00a0is\u00a0dus niet\u00a0alleen\u00a0de\u00a0grootte\u00a0van\u00a0elke\u00a0cel\u00a0die\u00a0telt, maar de\u00a0<strong>som\u00a0van\u00a0<\/strong>de<strong>\u00a0netto\u00a0oppervlakten\u00a0<\/strong>van\u00a0alle\u00a0entiteiten\u00a0die het\u00a0complex\u00a0vormen.\u00a0<\/p>\n\n\n\n<h3 class=\"wp-block-heading has-button-primary-color has-text-color has-link-color wp-elements-1d3520d65635c78c38b49bfadbfee788\"><strong>4.\u00a0Aankoopcategorie\u00ebn\u00a0en\u00a0bepalende\u00a0feiten<\/strong>\u00a0<\/h3>\n\n\n\n<p>Winkels\u00a0worden\u00a0ingedeeld\u00a0in 3\u00a0grote\u00a0categorie\u00ebn, van de\u00a0meest\u00a0gevoelige\u00a0tot\u00a0de\u00a0minst\u00a0gevoelige:\u00a0<\/p>\n\n\n\n<ul class=\"wp-block-list\">\n<li><strong>Lichte\u00a0aankopen\u00a0<\/strong>(persoonlijke\u00a0uitrusting,\u00a0kleine\u00a0huishoudelijke\u00a0apparaten,\u00a0lichte\u00a0vrijetijdsartikelen,\u00a0enz.\u00a0<\/li>\n<\/ul>\n\n\n\n<ul class=\"wp-block-list\">\n<li><strong>Voedingsmiddelen\/buurtwinkels\u00a0<\/strong>(dagelijkse\u00a0of\u00a0regelmatige\u00a0behoeften, op\u00a0lokaal\u00a0niveau).\u00a0<\/li>\n<\/ul>\n\n\n\n<ul class=\"wp-block-list\">\n<li><strong>Zware\u00a0aankopen\u00a0<\/strong>(zware\u00a0of\u00a0omvangrijke\u00a0producten,\u00a0weinig\u00a0frequente\u00a0aankopen:\u00a0meubilair,\u00a0elektro,\u00a0doe-het-zelf,\u00a0grote\u00a0sportuitrusting,\u00a0enz.\u00a0<\/li>\n<\/ul>\n\n\n\n<p>Alleen\u00a0al\u00a0de\u00a0overstap\u00a0naar\u00a0een\u00a0<strong>meer\u00a0gevoelige\u00a0categorie\u00a0<\/strong>kan\u00a0aanleiding\u00a0geven\u00a0tot\u00a0een\u00a0vergunningsplicht.\u00a0<\/p>\n\n\n\n<p>U\u00a0bent\u00a0vergunningplichtig\u00a0zodra\u00a0aan\u00a0\u00e9\u00e9n\u00a0van\u00a0<strong>de 5\u00a0voorwaarden\u00a0<\/strong>is\u00a0voldaan,\u00a0voor\u00a0een\u00a0netto\u00a0winkeloppervlakte\u00a0van\u00a0meer\u00a0dan 400 m\u00b2 (of 200 m\u00b2 indien de\u00a0gemeente\u00a0daartoe\u00a0heeft\u00a0besloten),\u00a0bijvoorbeeld:\u00a0<\/p>\n\n\n\n<ul class=\"wp-block-list\">\n<li>Bouw\u00a0van\u00a0een\u00a0<strong>nieuw\u00a0detailhandelspand<\/strong>.\u00a0<\/li>\n<\/ul>\n\n\n\n<ul class=\"wp-block-list\">\n<li>Bouw\u00a0van\u00a0een\u00a0<strong>nieuw\u00a0winkelcentrum<\/strong>.\u00a0<\/li>\n<\/ul>\n\n\n\n<ul class=\"wp-block-list\">\n<li><strong>Uitbreiding\u00a0<\/strong>van\u00a0een\u00a0winkel\u00a0of\u00a0winkelcentrum\u00a0<\/li>\n<\/ul>\n\n\n\n<ul class=\"wp-block-list\">\n<li><strong>Bestemming\u00a0van\u00a0<\/strong>een\u00a0gebouw\u00a0<strong>voor\u00a0commerci\u00eble\u00a0activiteiten\u00a0<\/strong>dat\u00a0daarvoor\u00a0niet\u00a0bestemd\u00a0was.\u00a0<\/li>\n<\/ul>\n\n\n\n<ul class=\"wp-block-list\">\n<li><strong>Aanzienlijke\u00a0wijziging\u00a0van de\u00a0aard\u00a0van de\u00a0commerci\u00eble\u00a0activiteit\u00a0<\/strong>(verandering\u00a0van\u00a0categorie\u00a0of\u00a0aanzienlijke\u00a0verschuiving\u00a0naar\u00a0een\u00a0meer\u00a0gevoelige\u00a0categorie).\u00a0<\/li>\n<\/ul>\n\n\n\n<p>Bijlage\u00a05\u00a0maakt\u00a0dan\u00a0deel\u00a0uit\u00a0van het\u00a0commerci\u00eble\u00a0luik\u00a0van de\u00a0stedenbouwkundige\u00a0vergunning. Dit document\u00a0toont\u00a0aan\u00a0dat\u00a0het\u00a0project\u00a0voldoet\u00a0aan\u00a0het SDT en\u00a0legt\u00a0uit\u00a0waarom\u00a0een\u00a0eventuele\u00a0afwijking\u00a0gerechtvaardigd\u00a0is\u00a0. In de\u00a0praktijk\u00a0wordt\u00a0bijlage\u00a05\u00a0bij\u00a0de\u00a0aanvraag\u00a0voor\u00a0een\u00a0stedenbouwkundige\u00a0vergunning\u00a0gevoegd\u00a0zodra\u00a0een\u00a0van de\u00a0bepalende\u00a0feiten\u00a0zich\u00a0voordoet.\u00a0<\/p>\n\n\n\n<p><\/p>\n\n\n\n<h2 class=\"wp-block-heading has-button-secondary-color has-text-color has-link-color wp-elements-a190a71272a04e7cee4b2de44af39390\">Praktische\u00a0toepassing: 2\u00a0gevallen\u00a0die\u00a0vragen\u00a0opriepen\u00a0<\/h2>\n\n\n\n<h3 class=\"wp-block-heading has-button-primary-color has-text-color has-link-color wp-elements-0b850da67e8122cc906fcc8d54ba8427\">Geval\u00a01 \u2013 Showroom en\u00a0afhaalzone\u00a0\u00a0<\/h3>\n\n\n\n<p>Context:\u00a0een\u00a0tegelwinkel\u00a0is\u00a0gevestigd\u00a0in\u00a0een\u00a0commercieel\u00a0geheel\u00a0dat\u00a0beschikt\u00a0over\u00a0een\u00a0PIC (Commerci\u00eble\u00a0Vestigingsvergunning).\u00a0<br>Volgens het\u00a0decreet\u00a0van 2015 en de circulaire van 2018\u00a0werd\u00a0deze\u00a0winkel\u00a0beschouwd\u00a0als\u00a0een\u00a0showroom en\u00a0werd\u00a0hij\u00a0niet\u00a0meegerekend\u00a0in de\u00a0netto\u00a0commerci\u00eble\u00a0oppervlakte:\u00a0hij\u00a0viel\u00a0dus niet onder het\u00a0commerci\u00eble\u00a0luik.\u00a0<\/p>\n\n\n\n<p>Vandaag\u00a0wil\u00a0de\u00a0winkel\u00a0\u201cuitbreiden\u201d\u00a0door\u00a0een\u00a0<strong>afhaalzone\u00a0voor\u00a0bestellingen\u00a0<\/strong>te\u00a0cre\u00ebren\u00a0die\u00a0toegankelijk\u00a0is\u00a0voor\u00a0het\u00a0publiek,\u00a0zonder\u00a0dat\u00a0er\u00a0goederen\u00a0worden\u00a0tentoongesteld.\u00a0<\/p>\n\n\n\n<ul class=\"wp-block-list\">\n<li>Huidige\u00a0netto\u00a0winkeloppervlakte:<strong>\u00a01.457 m<\/strong>\u00b2.\u00a0<\/li>\n<\/ul>\n\n\n\n<ul class=\"wp-block-list\">\n<li>Met de\u00a0afhaalzone:<strong>\u00a01.692 m\u00b2\u00a0toegankelijk\u00a0voor\u00a0het\u00a0publiek<\/strong>.\u00a0<\/li>\n<\/ul>\n\n\n\n<ul class=\"wp-block-list\">\n<li>Voor\u00a0het\u00a0project\u00a0is\u00a0een\u00a0<strong>bouwvergunning\u00a0nodig<\/strong>.\u00a0<\/li>\n<\/ul>\n\n\n\n<p><strong>De\u00a0vraag:\u00a0moet\u00a0bij\u00a0de\u00a0aanvraag\u00a0een\u00a0bijlage\u00a05\u00a0worden\u00a0gevoegd?<\/strong>\u00a0<\/p>\n\n\n\n<p>Antwoord\u00a0van\u00a0het Waals\u00a0Gewest:\u00a0<\/p>\n\n\n\n<ul class=\"wp-block-list\">\n<li>Volgens\u00a0het\u00a0decreet\u00a0van 2015\u00a0had\u00a0deze\u00a0winkel\u00a0inderdaad\u00a0<strong>geen\u00a0commerci\u00eble\u00a0vergunning\u00a0nodig<\/strong>.\u00a0<\/li>\n<\/ul>\n\n\n\n<ul class=\"wp-block-list\">\n<li>Maar op basis van\u00a0<strong>het\u00a0huidige\u00a0CoDT\u00a0<\/strong>wordt\u00a0het\u00a0wel\u00a0degelijk\u00a0gekwalificeerd\u00a0als\u00a0<strong>detailhandel<\/strong>.\u00a0<\/li>\n<\/ul>\n\n\n\n<ul class=\"wp-block-list\">\n<li>Daarom\u00a0<strong>is\u00a0bijlage\u00a05\u00a0vereist<\/strong>.\u00a0<\/li>\n<\/ul>\n\n\n\n<p>Als\u00a0er\u00a0een\u00a0<strong>handelsvergunning\u00a0<\/strong>bestaat\u00a0voor\u00a0het\u00a0geheel,\u00a0spreken\u00a0we\u00a0van\u00a0<strong>een\u00a0uitbreiding\u00a0van het\u00a0handelsgeheel<\/strong>, die\u00a0betrekking\u00a0moet\u00a0hebben\u00a0op\u00a0<strong>de totale\u00a0oppervlakte\u00a0van het\u00a0handelspand.<\/strong>\u00a0<br>Met\u00a0andere\u00a0woorden:\u00a0door\u00a0de\u00a0herclassificatie\u00a0van de showroom\u00a0als\u00a0detailhandel, in\u00a0combinatie\u00a0met de\u00a0uitbreiding,\u00a0valt\u00a0het\u00a0hele\u00a0verkooppunt\u00a0onder het\u00a0toepassingsgebied\u00a0van het SDT.\u00a0<\/p>\n\n\n\n<p><\/p>\n\n\n\n<h3 class=\"wp-block-heading has-button-primary-color has-text-color has-link-color wp-elements-b94d3b223a88cdfb19c9f3dd0b69bd22\">Geval\u00a02:\u00a0Installatie\u00a0van\u00a0laadpalen\u00a0op de\u00a0parkeerplaats:\u00a0buitenoppervlakte\u00a0die\u00a0moet\u00a0worden\u00a0opgenomen\u00a0in de\u00a0netto\u00a0commerci\u00eble\u00a0oppervlakte!\u00a0<\/h3>\n\n\n\n<p><\/p>\n\n\n\n<p>Context:\u00a0In het\u00a0kader\u00a0van\u00a0een\u00a0<strong>uitbreiding\u00a0van\u00a0een\u00a0bestaande\u00a0winkel\u00a0<\/strong>wil\u00a0de\u00a0eigenaar\u00a0<strong>laadpalen\u00a0voor\u00a0elektrische\u00a0voertuigen\u00a0<\/strong>op de\u00a0parkeerplaats\u00a0installeren.\u00a0<\/p>\n\n\n\n<p>Dit\u00a0roept\u00a0twee\u00a0vragen\u00a0op:\u00a0<\/p>\n\n\n\n<ul class=\"wp-block-list\">\n<li>Moeten\u00a0bij\u00a0een\u00a0<strong>uitbreiding\u00a0van\u00a0een\u00a0bestaande\u00a0winkel\u00a0de\u00a0parkeerplaatsen\u00a0met\u00a0laadpalen\u00a0worden\u00a0meegeteld\u00a0<\/strong>in de\u00a0commerci\u00eble\u00a0oppervlakte?\u00a0<\/li>\n<\/ul>\n\n\n\n<ul class=\"wp-block-list\">\n<li>Zo\u00a0ja,\u00a0wordt\u00a0het\u00a0<strong>feit\u00a0dat\u00a0een\u00a0commercieel\u00a0complex\u00a0wordt\u00a0gecre\u00eberd\u00a0dan\u00a0bepalend<\/strong>, in\u00a0plaats\u00a0van de\u00a0uitbreiding\u00a0van\u00a0een\u00a0bestaande\u00a0winkel?\u00a0<\/li>\n<\/ul>\n\n\n\n<p>Antwoord:\u00a0<\/p>\n\n\n\n<ul class=\"wp-block-list\">\n<li>Met\u00a0<strong>de\u00a0intrekking\u00a0van het IC-decreet\u00a0van 2015\u00a0<\/strong>is\u00a0het\u00a0besluit\u00a0dat\u00a0tankstations\u00a0van het\u00a0toepassingsgebied\u00a0uitsloot,\u00a0<strong>nietig<\/strong>\u00a0geworden.\u00a0<\/li>\n<\/ul>\n\n\n\n<ul class=\"wp-block-list\">\n<li>Resultaat:\u00a0<strong>tankstations\u00a0<\/strong>vallen\u00a0opnieuw\u00a0<strong>volledig\u00a0<\/strong>onder de\u00a0definitie\u00a0van\u00a0detailhandel.\u00a0<\/li>\n<\/ul>\n\n\n\n<ul class=\"wp-block-list\">\n<li>Op basis van de\u00a0juridische\u00a0analyses\u00a0is\u00a0er\u00a0<strong>geen\u00a0bewijs\u00a0<\/strong>om\u00a0tankstations\u00a0die\u00a0elektriciteit\u00a0verkopen\u00a0uit\u00a0te\u00a0sluiten\u00a0en\u00a0alleen\u00a0tankstations\u00a0die benzine\/diesel\/gas\u00a0verkopen\u00a0op te\u00a0nemen.\u00a0<\/li>\n<\/ul>\n\n\n\n<p>Praktische\u00a0gevolgen:\u00a0<\/p>\n\n\n\n<p><strong>Laadpalen\u00a0<\/strong>moeten\u00a0<strong>worden\u00a0opgenomen\u00a0in de\u00a0netto\u00a0commerci\u00eble\u00a0oppervlakte<\/strong>,\u00a0volgens\u00a0<strong>dezelfde\u00a0modaliteiten\u00a0als\u00a0tankstations<\/strong>:\u00a0<\/p>\n\n\n\n<ul class=\"wp-block-list\">\n<li>Netto\u00a0commerci\u00eble\u00a0oppervlakte\u00a0=\u00a0<strong>luifel.<\/strong>\u00a0<\/li>\n<\/ul>\n\n\n\n<ul class=\"wp-block-list\">\n<li>Bij\u00a0gebrek\u00a0daaraan,\u00a0<strong>oppervlakte\u00a0die\u00a0door\u00a0auto\u2019s\u00a0wordt\u00a0ingenomen\u00a0tijdens\u00a0het\u00a0laden.<\/strong>\u00a0<\/li>\n<\/ul>\n\n\n\n<p>Op basis van\u00a0deze\u00a0informatie\u00a0zou\u00a0het\u00a0<strong>feit\u00a0dat\u00a0aanleiding\u00a0geeft\u00a0tot\u00a0belastingheffing\u00a0<\/strong>dus a priori de <strong>oprichting\u00a0van\u00a0een\u00a0commercieel\u00a0complex\u00a0<\/strong>zijn.\u00a0\u00a0<\/p>\n\n\n\n<p class=\"has-text-color-color has-text-color has-link-color
